“THIRD PARTY CONTENT” refers to any content belonging to a specific hotel company, brand and/or authorized affiliates that has been sourced for the purpose and function of “THE SITE” as defined in the “SCOPE OF SERVICES”.

GLOBODIME INVESTMENTS LIMITED, UK trading as LUXOSTAY herein collectively referred to as “LUXOSTAY, WE, OUR, US”, are the owners, operators, and sole custodians of the LUXOSTAY BRAND, the LUXOSTAY LOGO, the luxostay.com (the “SITE”), related applications and other affiliated entities.

TERMS OF USE

BY ACCESSING, USING, VIEWING, TRANSMITTING, CACHING OR STORING THIS SITE OR ANY OF ITS SERVICES, FUNCTIONS, MATERIALS OR CONTENTS, YOU SHALL BE DEEMED TO HAVE READ, UNDERSTOOD AND ACCEPTED ALL THE TERMS AND CONDITIONS AS WELL AS NOTICES IN THIS SITE WITHOUT DEVIATION.

We reserve the right to change, modify and revise these terms and conditions without prior notice.

THE “SITE” SCOPE OF SERVICES

Luxostay.com is a five-star hotel discovery platform lists curates, lists, and showcases specific luxury hotels internationally using content sourced exclusively from authorized intellectual property custodians including directly from the relevant hotel brands, its affiliates and other duly appointment representatives.

The “SITE” contains carefully selected hotel content including descriptions, images, photos, videos, and other related content. Luxostay provides users a list of ultra-luxury five (5) star hotels, relevant information, and associated links to either the respective hotel website or related booking/affiliate links. Luxostay does not provide direct hotel bookings, it is neither a booking nor a travel agency.

These services are strictly handled by either the hotels directly or authorized booking agencies. As such LUXOSTAY shall not and cannot be held liable for any hotel booking, services, or prejudice suffered from any booking, experience, service or any associated transaction emanating from the LUXOSTAY platform. 

OWNERSHIP AND RIGHTS OF USE

All rights, including but not limited to copyrights, trademarks, colors, names, slogans (primarily “Opulent Discoveries”) and other intellectual property elements are hereby reserved.

Any content that is contained and/or featured in the luxostay.com website and other associated platforms that is created for the LUXOSTAY “SITE”, is the property of LUXOSTAY and any THIRD PARTY CONTENT including but not limited to; (“images, videos, hotel information, references, related materials, property data, other intellectual property elements”) featured on the LUXOSTAY “SITE” strictly belong to their respective owner, custodians and their authorized representatives. 

“THIRD PARTY CONTENT” is strictly used subject to compliance with their respective rights-to-use policies and their terms and conditions as defined in their image and media source platforms. Luxostay may not and does not authorize any user who uses “THE SITE” to re-use, acquire or modify “THIRD PARTY CONTENT” without the express permission of its respective owners.

We are not authorized to grant or extend any rights on “THIRD PARTY CONTENT” whether right-to-use or whatsoever to any third party who uses the “LUXOSTAY” site except for the purpose of the “SITE” within the prescripts of the agreement between US (Luxostay) and the respective intellectual property owners. 

We grant you the limited rights to use the “SITE” in compliance with the terms and conditions of this agreement. Your license to use this “SITE” is non-exclusive, revocable, non-transferable subject to compliance with the provisions of this agreement. You may use and browse this site strictly for your information and personal and commercial use subject to compliance with the “RIGHTS TO USE” policy of this “SITE”. The copying, reproduction, replicating or emulating of this “SITE” is strictly prohibited.

Where we provide hypertext links to other locations on the Internet, we do so for information purposes only. We are not responsible for the content of any other websites or pages linked from or linking to this Site. 

Following links to any third-party websites or pages is done strictly at your own risk and “WE” shall not be held responsible or liable for any damages, prejudice or loss incurred thereof.  When you link to an external platforms or websites, we urge you to familiarize yourself with their respective terms and conditions.

By using this website or any information on it, including but not limited to images, videos, audios, social media posts, and other related content, you acknowledge that you have read and agree to the terms in this disclaimer. If you do not agree with these terms, you are strictly prohibited from using this website.

The material displayed on this “SITE” is provided without any guarantees, conditions, or warranties as to its accuracy or completeness. We will not be held liable for any prejudice, damages incurred or suffered due to the information or links emanating from the “SITE”.

INDEMNITY

You agree to indemnify, defend, and hold harmless LUXOSTAY, its affiliates, agents, employees, and licensors from and against any and all claims and expenses, including reasonable attorney fees, arising out of, or related in any way to your use of the site, violation of this Agreement, violation of any law or regulation, or violation of any proprietary or privacy right.

Though we take every effort to qualify, verify, research the content we publish on this “SITE”, WE are not responsible for the content, experience or transactions processed on any third-party website, platform emanating from a direct or indirect link on Luxostay.com.

GOVERNING LAW

The British courts will have exclusive jurisdiction over any claim arising from, or related to, a visit to our Website although we retain the right to bring proceedings against you for breach of these conditions in your country of residence or any other relevant country. 

These Terms of Website Use and any dispute or claim arising out of or in connection with them or their subject matter or formation (including non-contractual disputes or claims) shall be governed by and construed in accordance with the laws of the United Kingdom.
